Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Sportango, Inc. ("Sportango," "we," "us," or "our") governing your access to and use of the Sportango platform, website, and related services (collectively, the "Service").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

Sportango is a unified management platform for racket sports facilities. The Service includes court booking and scheduling, program and coaching management, payment processing, membership management, fitness tracking, and analytics — across tennis, pickleball, padel, badminton, squash, and table tennis.

We may update, modify, or discontinue features of the Service from time to time. We will provide reasonable notice of material changes that may adversely affect your use of the Service.

3. Accounts

3.1 Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 Account Types

• Facility Administrators: Full access to configure facility settings, manage staff, and view reporting
• Staff & Coaches: Access to scheduling, program management, and member interactions
• Members: Access to booking, enrollment, payments, and personal profiles

4. Subscriptions & Billing

4.1 Pricing

Sportango offers subscription plans at flat monthly or annual rates. Current pricing is available at sportango.com/pricing. We charge zero transaction fees on your payment volume — you only pay standard Stripe processing fees (typically 2.9% + 30¢).

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by applicable law. We may change our pricing with 30 days written notice.

4.3 Free Trial

We offer a 7-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, you may choose a paid plan to continue using the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute the Service without written consent
• Upload or transmit malicious code, viruses, or harmful data

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and all related intellectual property, is owned by Sportango and protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

7. Data Ownership

You grant Sportango a limited license to use, process, and store your data solely to provide and improve the Service. We will not access your data except as necessary to deliver the Service, provide support at your request, or comply with legal obligations.

8. Third-Party Services

The Service integrates with third-party providers including Stripe (payment processing), Kinde (authentication), and others. Your use of third-party services is subject to their respective terms and privacy policies. Sportango is not responsible for the availability, accuracy, or practices of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SPORTANGO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTANGO'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SPORTANGO DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SPORTANGO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Termination

Either party may terminate these Terms at any time with 30 days written notice. Sportango may suspend or terminate your access immediately if you breach these Terms or engage in conduct that may harm Sportango or other users.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days after termination, during which you may export it. After 90 days, your data will be permanently deleted unless a longer retention period is required by law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Travis County, Texas.

13. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by email and update the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
